Riley County Attorney comments on alleged Ogden open meetings violations

The same day the vote canvass in the Ogden Mayor Jimmy Bond recall election determined no change in the result, the Riley County attorney has announced he has found no real wrong-doing by Bond. In a letter addressed to Ogden City Attorney Bern Irvine, Riley County Attorney Barry Wilkerson details his review of documents relating to Ogden City Commission meetings of July 15th and August fifth. Wilkerson indicates he also reviewed not only the meetings, but the powers and authorities vested in the Ogden City Council and Mayor as set forth in city code. Regarding a July 15th meeting which involved council members and RIM developers, no one was named, with Wilkerson saying until such information is provided he is not able to further review the allegations surrounding that meeting. As for the August fifth decision to close the pool, Wilkerson says the decision whether or not to open or close the pool rests in the discretion of the mayor, with no code designating the city council to make such a decision. The county attorney goes on to say quote “Bonds’ pronouncement immediately after executive session that the city pool would be closed on August sixth, 2009 was not a violation of the Kansas Open Meetings Act, because it was not an act that required the city council’s vote or approval of such action by the governing body.”
